TERMS OF SERVICE

These Terms of Service ("Terms") are an agreement between you and Buildpal ("Buildpal," "we," "us") and govern your use of the Buildpal Worker app, the Buildpal Supervisor app, Buildpal OS, our websites, and our related services (together, the "Services"). Please read them carefully. By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

1. AGREEMENT TO THESE TERMS
By accessing or using the Services you confirm that you accept these Terms and agree to comply with them. If you use the Services on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms, and "you" refers to that organisation.
2. WHO CAN USE BUILDPAL
You must be at least 18 years old and legally able to work and to enter contracts. You must give accurate, current, and complete information and keep it up to date. We may refuse, suspend, or remove accounts at our reasonable discretion, including where verification fails or information is false.
3. YOUR ACCOUNT AND VERIFICATION
You are responsible for your account and for keeping your PIN or password confidential. Do not share your account or let anyone else use it, and tell us immediately if you suspect unauthorised use. To keep the platform trustworthy, we verify identities (KYC), which may require your national identity number, identity documents, and a selfie. You confirm that everything you submit is genuine and belongs to you.
4. WHAT BUILDPAL IS
Buildpal is a technology platform. For workers, it provides a verified profile, job matching, attendance, payments, and reputation. For contractors and organisations, Buildpal OS provides project and workforce tools. Buildpal helps workers and organisations find and work with each other and facilitates attendance records and payment. Buildpal is not a party to the work carried out between a worker and an organisation, and does not direct how that work is performed. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Buildpal except as we expressly agree in writing.
5. IF YOU ARE A WORKER
You choose the jobs you accept. When you accept a booking, you agree to attend and to perform the work professionally and safely, to follow reasonable site rules, and to check in and out through Buildpal so that your attendance and pay are recorded accurately. Your profile, ratings, and reputation reflect your work. Do not misrepresent your trades, skills, or certifications, and do not accept work you are not able or qualified to do safely.
6. IF YOU ARE A CONTRACTOR OR ORGANISATION
You are responsible for the projects and sites you run, for the accuracy of the jobs you post, and for providing a safe and lawful working environment consistent with applicable law. You may see the work-relevant parts of a worker's profile, but you must use it only to manage work on your projects. You must not attempt to obtain workers' identity documents, private contact details, or payout information, and you must not contact or pay workers off-platform in order to avoid fees or the protections these Terms provide.
7. PAYMENTS, WALLET AND FEES
Buildpal calculates worker pay rates; workers do not set their own rates. Approved earnings are credited to your in-app wallet, and you can withdraw them to your chosen mobile-money account, subject to any minimums, limits, and processing times. Buildpal may charge fees or commissions for use of the Services, and we will make these clear before they apply. You are responsible for any taxes due on your earnings. Payments are processed by third-party mobile-money and payment providers, whose terms also apply to those transactions.
8. RATINGS, REPUTATION AND VERIFICATION
Ratings, attendance history, and reputation tiers help keep the platform fair for everyone. Do not manipulate ratings, create fake or duplicate accounts, or misrepresent your identity or history. We may adjust, withhold, or remove reputation data that we reasonably believe is inaccurate or was obtained unfairly.
9. ACCEPTABLE USE
When using the Services, you agree that you will not:
- use the Services for any unlawful, fraudulent, or harmful purpose, or misrepresent your identity, trades, or qualifications;
- harass, threaten, defraud, or discriminate against any other user;
- circumvent verification, fees, payments, or the protections these Terms provide, including by arranging work or payment off-platform;
- interfere with, disrupt, or attempt to gain unauthorised access to the Services, other accounts, or our systems;
- copy, scrape, reverse engineer, or upload viruses or malicious code; or
- infringe the rights of others or breach any applicable law.
10. YOUR CONTENT AND COMMUNICATIONS
You are responsible for the content you submit, including messages, documents, images, and voice notes. Do not submit anything unlawful, false, or that infringes the rights of others. You grant Buildpal a limited licence to host, store, and use your content only as needed to operate, secure, and improve the Services. Keep communications professional, and be aware that we may review content where necessary to keep the platform safe and to comply with law.
11. INTELLECTUAL PROPERTY
Buildpal and its logos, software, and content are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, and revocable licence to use the Services for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of the Services except as allowed by law or with our written permission.
12. THIRD-PARTY SERVICES
The Services rely on third parties such as SMS, map, cloud-storage, authentication, and mobile-money providers. We are not responsible for third-party services, and your use of them may be subject to their own terms and privacy notices.
13. SERVICE AVAILABILITY AND CHANGES
We work to keep the Services available, but we do not guarantee that they will be uninterrupted or error-free. We may add, change, suspend, or remove features, and we may set limits, at any time. Some features depend on your device, your network, and your location, and may not work without them.
14. DISCLAIMERS
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind. We do not warrant that the Services will meet your requirements, be secure, or be free of errors, or that any job, worker, organisation, or outcome will meet your expectations. Buildpal facilitates connections, attendance records, and payments, but does not guarantee the conduct, quality, safety, or reliability of any user.
15. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Buildpal will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, earnings, data, or goodwill. Our total liability arising out of or relating to the Services is limited to the greater of the fees you paid to us in the three months before the event giving rise to the claim, or a reasonable amount as required by applicable law. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
16. INDEMNITY
To the extent permitted by law, you agree to indemnify and hold Buildpal harmless from claims, losses, and reasonable costs arising from your use of the Services, your content, the work you perform or the workers you engage, or your breach of these Terms or of applicable law.
17. SUSPENSION AND TERMINATION
You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or where required by law. When your access ends, your right to use the Services stops, but the provisions that by their nature should continue (such as payment, disclaimers, liability, indemnity, and dispute terms) will survive. We handle your data on account closure as described in our Privacy Policy.
18. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the Republic of Rwanda. If a dispute arises, we encourage you to contact us first so we can try to resolve it. Any dispute that cannot be resolved will be subject to the competent courts of Rwanda, without affecting any mandatory rights you may have under applicable law.
19. CHANGES TO THESE TERMS
We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date and, for material changes, notify you in the app or by other reasonable means. If you continue to use the Services after an update, you accept the revised Terms.
